The managers of the portal www.bibe.me and the BIBE Control application (hereinafter BIBE) comply with the requirements established in Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce, in Regulation (EU) 2016/679 on the Protection of Personal Data, and other European directives, and for this purpose have created these terms of use.

BIBE offers through the portal a ticket sales system, its purpose is to provide organizers with a web tool to organize and self-manage their events. The use of the portal grants the visitor, client, or buyer (hereinafter User), as well as the event organizer whether a company, freelancer, or organization (hereinafter Organizer) full and unconditional acceptance of all the provisions included in these terms of use. If the User does not agree with any of the conditions set forth herein, they must not use/access www.bibe.me.
Use of the aforementioned portal shall be subject to the following Conditions, which may be updated periodically. Likewise, the managers of the portal reserve the right to modify the website, the services offered and any information accessible through the portal, notifying organizers of the changes made. Use of the portal presumes full understanding and express acceptance of these conditions by the User and the Organizer. Access or use implies acceptance by the User and Organizer of all the general conditions published by BIBE at the time of such access or use.
BIBE managers reserve the right to improve, modify, or unilaterally remove the service and/or content of the portal according to diverse criteria, notifying organizers of the changes made.
Users: visitor, client, or buyer. BIBE managers may establish special conditions for contracting or using certain services or products offered to Users on the website.
Organizer: company, freelancer, organization, public or private entity.
Online ticketing: The tool made available through the website www.bibe.me consists of an event organization and ticket sales system.
Subsequent control: To carry out ticket control, BIBE offers 3 different options: list, reading QR codes via Android mobile devices, and through specific readers that must be requested from BIBE managers.
Prices, accounting, and other functions: BIBE offers an Internet platform for online ticket sales and subsequent control. The Website provides Organizers with temporary licenses for the duration of the contract, and in no case involves transfer or assignment of rights beyond those necessary for its mere use on the Internet and only through the Website of the following products and services. The Organizer may include an identity and event description, attach photos, and upload their own logo, always respecting intellectual, industrial, image, and data protection rights of third parties.
The information and materials that the Organizer places on BIBE may be used by both BIBE and third parties.
The Organizer is responsible for all the information that appears about their event and for its management. They must respond to cancellations and/or changes that may occur, as well as to tickets already sold for the event and to buyers’ needs.
Regarding the refund and return policy, BIBE managers will contact the Organizer of the event to determine in which cases ticket money should be refunded. In principle, refunds will not be accepted.
Payment methods: BIBE provides Users or Organizers with different ways to pay for tickets:
Ticket prices will be expressed in euros and cents of euro (e.g.: 1.30 €), with a maximum of two decimal places.
Language: BIBE is designed to work in four languages: Basque, Spanish, French, and English.
When a sale is made through BIBE, the revenue goes to the account of the platform managers. At the end of the event, an invoice with the event data is issued and sent to the Organizer, depositing the money into the bank account provided during registration, minus commission and any additional services requested.
BIBE managers charge 10% of the ticket price set by the Organizer. The Organizer decides when to close ticket sales and BIBE issues an invoice along with the transfer. To prepare invoices, the Organizer must provide all their data and is responsible for ensuring it is updated and valid. Otherwise, BIBE will retain the corresponding event earnings for 6 business months. After that period, it will be understood that the Organizer does not wish to receive the corresponding earnings, which will be allocated to the maintenance and development of the BIBE platform.
In case of event cancellation, the Organizer will assume 1% of the total revenue as cancellation costs due to debit or credit card refund fees, with a minimum of one euro (€1) per ticket sold and canceled. Paypal refunds will be governed by Paypal’s current refund conditions.
In the event that the transfer generates bank charges, these will be borne by the Organizer and will also be deducted from the amount transferred.
Exclusive system changes requested by Organizers are carried out after preparing a project proposal and budget with execution deadlines, and once accepted by the Organizer. These works may vary depending on the Organizer’s needs, and the price will be adjusted according to the hours required by each project.
Obligations and Responsibilities: The User undertakes to make good use of the portal and not to use it to engage in illegal activities, contrary to good faith or legal order (by way of example but not limitation); cause damage to BIBE’s physical and logical systems, to its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems likely to cause the aforementioned damage, without forgetting those that violate or infringe upon the honor, personal or family privacy, or image of third parties, or that are illegal or against morality, leaving the User or Organizer in any case harmless against BIBE managers for any claim, judicial or extrajudicial.
Any use different from the purpose of this Website is expressly prohibited.
BIBE will ensure, as reasonably as possible, the proper functioning of the Website, the correction of its content, and the truthfulness of what is published on it. However, it is not responsible for errors or omissions that may affect the content of the Website or other content accessible through it.
BIBE will not be liable for any damage caused to the User or Organizer in case of inability to provide the service due to force majeure or other causes not attributable to the portal managers.
BIBE will not be responsible for any malfunction of the portal if due to maintenance work and similar, incidents affecting servers or international operators, misconfiguration of the User’s and/or Organizer’s equipment, or insufficient capacity to support the necessary systems to use the portal.
The User and/or Organizer agrees and is responsible for not using any tool, software, or routine to interfere or attempt to interfere with the normal operation of the portal www.bibe.me or any sale being made. BIBE reserves the right to block or delete the account of any User or Organizer if it discovers manipulation of the event organization process or operation of the same and/or its website.
BIBE will prosecute breaches of the above conditions as well as any misuse of the portal, being able to block or delete the User’s and/or Organizer’s account, as well as exercise all civil and criminal actions available under the law.
Legal claims against BIBE or its collaborators for damages caused to users will only be acceptable in cases of gross negligence or breach of contractual obligations to users.
If the event does not take place, BIBE is not responsible and the claim must be directed to the organizer of said event. BIBE is not responsible for the success, compliance with obligations, or responsibilities arising from the event.
BIBE and its managing company will not be responsible for the relationship of the user with the event attendees.
Communications and notifications: All communications and notifications made will be considered effective for all purposes when sent by email to the address provided by the User and/or Organizer. The User and/or Organizer is obliged to keep BIBE informed of any changes in their personal data and email address in order to be informed of relevant events. The User and/or Organizer expressly acknowledges that such data has been provided by themselves and is entirely true.
Full responsibility for determining the specific content and services that minors access lies with the adults in charge. As the Internet makes it possible to access content that may not be appropriate for minors, Users are informed that there are mechanisms, particularly filtering and blocking software, that allow limiting the available content, and although not infallible, are useful to control and restrict the material that minors can access.
BIBE warns that any User and/or Organizer who wishes to use the ticket sales system must be of legal age and not legally incapacitated to enter into any type of contract or purchase. BIBE reserves the right to block or delete a User’s and/or Organizer’s subscription to the portal if it reliably confirms non-compliance with this obligation.
The portal uses cookies, which are physical information files stored on the User’s device that serve to facilitate navigation of the portal. The User may configure their browser to prevent installation of these files.
The portal managers assume no responsibility for external links that may be included, since they have no control over them. The User accesses them under their own exclusive responsibility and subject to the terms of use that govern them.
Likewise, the establishment of a link does not imply any relationship between BIBE and the owner of the linked website, nor the acceptance or approval of its content or services.
BIBE will respect the law or third-party rights once notified of any violation, after verifying its truthfulness.
The personal data provided by the User are owned by Akting. Akting undertakes to comply with Regulation (EU) 2016/679 on the Protection of Personal Data. The personal data that Users provide through the portal will be treated confidentially and will form part of a file. Personal data will be used solely for the management, administration, and provision of the ticket sales service offered through the portal.
Likewise, the User may exercise their rights of access, rectification, cancellation, and opposition in accordance with Regulation (EU) 2016/679, on the Protection of Personal Data, at the following address: Paseo Mikeletegi 71 - 3rd Floor, 20.009 Donostia - San Sebastián or at the email address: info@bibe.me.
The Organizer may unsubscribe at any time; BIBE reserves the right to ask for reasons for statistical purposes and service improvement. The User may also unsubscribe at any time by writing to info@bibe.me.
The Organizer and/or User guarantees that the Personal Data provided are truthful and is responsible for communicating any changes to them. The User and/or Organizer will be solely responsible for any damage or harm, direct or indirect, that may be caused to BIBE or to any third party as a result of filling out forms with false, inaccurate, incomplete, or outdated data. BIBE has the right to cancel, even without prior notice, a User and/or Organizer who does not comply with legal requirements, provided there are justified reasons.
BIBE has adopted the necessary measures to prevent alteration, loss, treatment, or unauthorized access to personal data, taking into account the state of technology at all times. However, the User must be aware that Internet security measures are not infallible.
Completing both the registration form and the data provided for ticket purchases included in the portal implies the User’s and/or Organizer’s express consent to the inclusion of their personal data in the aforementioned automated file of BIBE. If personal data of third parties are included, the person completing the form must, prior to inclusion, inform them of the provisions set forth above.
BIBE may store and use the IP addresses of Users of this portal in order to analyze traffic, manage the portal, and monitor portal usage as a whole. BIBE will never associate IP addresses with personally identifiable information. BIBE may also use web analytics services (e.g. Google Analytics or similar tools) to help analyze how Users use the website.
All industrial and intellectual property rights of www.bibe.me and its contents (texts, images, sounds, audio, video, designs, creations, software) belong to BIBE managers.
The User may view all elements, print, copy, and store them on their computer hard drive or on any other physical medium solely and exclusively for personal and private use, and therefore their use for commercial purposes, distribution, modification, alteration, or decompilation is strictly prohibited.
The parties acknowledge that these Website Terms of Use are governed in every respect by Spanish law.
The provision of the service is, in principle, indefinite. BIBE, however, is authorized to terminate or suspend service at any time by notifying users fifteen days in advance.
Such suspension or withdrawal shall in no case give rise to any right to compensation.
For any discrepancy in these terms, the parties submit to the Courts and Tribunals that correspond according to the applicable regulations.
